Additional Terms and Conditions for the “Bring Your Own Frame” Service
Customer-Provided Frames: By participating in Frame Fiesta’s “Bring Your Own Frame” service (“Service”), the customer acknowledges and agrees that they are providing their own frames (“Customer Frames”) for the purpose of lens installation, inspection, adjustment, or other related services performed by Frame Fiesta. The Customer Frames are submitted entirely at the customer’s own risk.
Assumption of Risk: The customer expressly assumes all risk of loss, damage, theft, or breakage to the Customer Frames at all times, including during shipping, handling, inspection, lens installation, and return delivery. Frame Fiesta does not warrant the structural integrity, quality, durability, or suitability of any Customer Frames provided.
No Guarantee of Fit or Condition: Frame Fiesta makes no guarantee or representation that the Customer Frames will be compatible with the customer’s chosen lenses, prescriptions, or any modifications requested. Any adjustments or modifications to the Customer Frames are performed solely at the customer’s request and risk.
Limited Liability for Damages: Frame Fiesta shall not be liable for any damage to, or destruction of, Customer Frames arising from any cause whatsoever, including but not limited to handling, inspection, installation, modification, packaging, shipping, or miscommunication of specifications. In the event Frame Fiesta, at its sole and exclusive discretion, decides to reimburse the customer for damages to their Customer Frames, such reimbursement shall not exceed a total of Two Hundred and Fifty Dollars ($250.00) of store credit under any circumstances. This limited reimbursement, if granted, shall be the customer’s sole and exclusive remedy, and the customer releases Frame Fiesta from all other liabilities, claims, or damages.
No Warranties: Except as otherwise provided herein, Frame Fiesta disclaims all warranties, express or implied, related to the “Bring Your Own Frame” Service and the handling or modification of Customer Frames, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Indemnification: The customer agrees to indemnify, defend, and hold harmless Frame Fiesta and its officers, directors, employees, agents, affiliates, successors, and assigns, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or relating to the use of the “Bring Your Own Frame” Service or the handling, modification, or return of the Customer Frames.
Acceptance of Terms: By submitting their frames to Frame Fiesta, the customer represents that they have read, understood, and agree to be bound by these additional terms and conditions. If the customer does not agree to these terms, they should not use the “Bring Your Own Frame” Service.
These terms and conditions are in addition to, and do not limit or replace, any other terms and conditions published by Frame Fiesta. In the event of a conflict between these additional terms and conditions and any other Frame Fiesta policy, these terms and conditions shall govern with respect to the “Bring Your Own Frame” Service.
